Becoming a British citizen is a significant milestone. It confirms your right to live in the United Kingdom permanently, opens the door to a British passport, and (for many) represents the end of a long immigration journey. At Kreston Solicitors, our London nationality and citizenship team in Enfield has helped many clients across North London and Greater London to achieve British citizenship, whether by naturalisation, registration, or recognition of a right already held.

British nationality law is governed by the British Nationality Act 1981 and its many amendments. The rules have evolved significantly in recent years, and complex issues often arise in relation to residence, absences, good character, and the treatment of children. Expert advice from experienced London citizenship solicitors saves time, money and disappointment.

Routes to British Citizenship

Naturalisation as a British Citizen (Form AN)

Adults who hold Indefinite Leave to Remain (or EU Settled Status) can usually apply to naturalise as British citizens. Our London naturalisation solicitors help you show that you:

  • Are aged 18 or over and of sound mind
  • Are of good character
  • Meet the residence requirement, normally 5 years’ lawful residence and 12 months of ILR (or immediate after ILR if married to a British citizen)
  • Have not exceeded the permitted number of absences
  • Meet the English language requirement at B1 CEFR level (unless exempt)
  • Have passed the Life in the UK Test (unless exempt)
  • Intend to continue to live in the UK

Registration of Children as British Citizens

Children born in the UK are not automatically British if neither parent was British or settled at the time of their birth. However, many children can be registered as British citizens, for example if:

  • A parent becomes British or settled after the child’s birth
  • The child was born in the UK and has lived here for the first 10 years of their life (often a strong route)
  • The child is being registered under the discretionary provisions based on future connection with the UK
  • The child is a stateless person born in the UK

Our London nationality lawyers help parents across North London navigate these provisions, whether for a newborn baby, teenager, or an adult child who was born in the UK.

Good Character Requirement

Under section 6 of the British Nationality Act 1981, applicants for naturalisation must be of ‘good character’. The Home Office applies strict guidance in this area. Criminal convictions (even minor ones) deception, non-compliance with immigration conditions and certain financial matters (such as bankruptcy or unpaid taxes) can all result in refusal. Our London nationality lawyers carry out a full assessment before you apply.

Residence, Absences and Future Intention

Many refusals arise from absences from the UK beyond the permitted limits, or from unclear evidence of your travel history. Our citizenship solicitors work carefully with your travel records, passport stamps, airline records and absence log to ensure that you meet the residence test.

British Passport Applications

Once you are a British citizen, you can apply for a British passport. Our London immigration lawyers assist clients who have faced delays or refusals in their passport applications (often related to evidence of entitlement) and can work with HMPO on your behalf.

FAQs

Frequently Asked Questions

Most applicants must wait at least 12 months after obtaining Indefinite Leave to Remain (or EU Settled Status) before applying to naturalise. If you are married to a British citizen, you can apply immediately after getting ILR. The Government has consulted on significant changes to settlement and citizenship routes, so timing is increasingly important, our London citizenship solicitors will advise based on the rules in force when you apply.

In the five years before the date of your application you should not have been absent for more than 450 days in total, and not more than 90 days in the final 12 months. Shorter periods apply for spouses of British citizens. The Home Office has discretion where absences are exceeded, but it is not automatic.

Possibly. The good character test is strict. Custodial sentences, suspended sentences, recent cautions, and even fixed-penalty notices can lead to refusal or require you to wait a qualifying period. Our London nationality lawyers carry out a pre-application assessment so you know where you stand before paying fees that are not refunded.

Yes, unless you are exempt (usually on age or mental capacity grounds, or because you have previously passed it). The test has 24 multiple-choice questions and you need at least 75% to pass.

Yes. Kreston Solicitors is at 44 London Road, Enfield, easy to reach from Edmonton, Palmers Green, Southgate, Wood Green, Tottenham, Haringey and Barnet. We also serve clients across London and nationally.

Not automatically. A child born in the UK is British at birth only if a parent was British or settled at the time of birth. Otherwise, the child may become British if a parent later becomes British or settled, or (importantly) by registration after 10 years’ residence in the UK. Our London citizenship solicitors help many North London families with registration applications.

British citizenship can be revoked in very limited circumstances, for example where it was obtained by deception, or where deprivation is considered conducive to the public good. Voluntarily renouncing British citizenship is also possible. If you face deprivation proceedings, specialist legal advice is essential.
